Please read these terms carefully before using our property management services.

1. Agreement to Terms
By engaging Aether Nest Estates ("we," "us," or "our") for property management services, you ("Client" or "you") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Aether Nest Estates.
2. Services Provided
Aether Nest Estates provides comprehensive property management services including but not limited to:
- Property marketing and guest acquisition
- Guest screening and booking management
- Property maintenance and cleaning coordination
- Revenue optimization and pricing strategies
- Guest communication and support
- Financial reporting and payment processing
3. Client Responsibilities
As a property owner, you agree to:
- Provide accurate property information and documentation
- Maintain the property in good condition
- Comply with all local laws and regulations
- Provide necessary keys, access codes, and property access
- Maintain appropriate insurance coverage
- Respond promptly to urgent maintenance requests
4. Fees and Payment
Management fees are calculated as a percentage of gross rental income as outlined in your management agreement. Additional fees may apply for:
- Property setup and onboarding
- Deep cleaning services
- Maintenance and repairs beyond normal wear
- Marketing photography and styling
All fees are due as specified in your management agreement. Late payment may result in service suspension.
5. Liability and Insurance
While we exercise reasonable care in managing your property, Aether Nest Estates is not liable for:
- Damage caused by guests beyond our control
- Market fluctuations affecting rental income
- Force majeure events
- Third-party service provider failures
Property owners must maintain comprehensive insurance coverage including public liability and property damage protection.
6. Termination
Either party may terminate this agreement with 30 days written notice. Upon termination:
- All pending bookings will be honored
- Final financial settlement will be processed within 14 days
- Property access materials must be returned
- Client data will be handled according to our Privacy Policy
7. Confidentiality
We maintain strict confidentiality regarding your property information, financial data, and personal details. This information is used solely for providing our services and will not be shared with unauthorized third parties.
8. Dispute Resolution
Any disputes arising from this agreement will be resolved through:
- Good faith negotiation between parties
- Mediation if negotiation fails
- Arbitration as a final resort
All disputes will be governed by South African law and handled in Cape Town jurisdiction.
9. Modifications
We reserve the right to modify these terms with 30 days notice. Continued use of our services after modification constitutes acceptance of the new terms.
